AAUA student’s rape: Court remands alleged Soldier in prison

A 33-year-old soldier, Sunday Awolola, who allegedly molested a female student of Adekunle Ajasin University, Akungba Akoko, AAUA, (name withheld), has been remanded in prison custody by an Akure Chief Magistrate’s Court sitting in Akure, the Ondo State capital.
The presiding magistrate, Mr Mayomi Olanipekun, gave the order following an application brought by the prosecuting police inspector, Adeoye Adesegun, for his remand pending the advice from the office of the Director of Public Prosecution in the state Ministry of Justice.
Awolola, who was arraigned on a counts bothering on rape, was said to have committed the offence on July 31, 2019, at about 6:30pm at Akoko Military check point.
The prosecution said the offences contravened sections 357 and 358 of the Criminal Code, Cap 37, Volume 1, Laws of Ondo State.
The plea  of the defendant was not taken.
The Prosecuting Inspector, Adeoye Adesegun, had moved a motion on notice to remand the defendant in prison custody to enable him send the duplicate of the case file to the Director of Public Prosecution for advice.
But  Counsel to the defendant,  Mr. Kayode Ikotun, brought a counter affidavit to oppose the remand application moved by the prosecutor.
Ikotun submitted that the defendant was on medical attention, hence putting him in prison would endanger him.
Ikotun, therefore, prayed the court to admit the defendant to bail, while he promised to provide a substantial surety.
The court discountenance the defence counsel application for bail and ordered the remand of the defendant at Olokuta prison custody pending the issuance of the legal advice from the DPP’s office.
The magistrate, Mr. Olanipekun, adjourned the case till November 15, 2019.
