Court adjourns hearing on Osun LG tenure dispute to Nov 27

The Federal High Court sitting in Osogbo, Osun State, on Monday, October 13, 2025, adjourned to November 27, 2025, for hearing in a suit filed by reinstated Chairmen and Councillors of the All Progressives Congress (APC), seeking legal determination of their tenure and challenging the legitimacy of local government elections allegedly conducted by the incumbent Governor, Ademola Adeleke, in February 2025.

The matter, filed as Suit No. FHC/OS/CS/147/2025: Onibonokuta Saheed & 7 Ors v. Attorney General of the Federation & 6 Ors, seeks among other reliefs, a declaration on whether the claimants are entitled to a three-year tenure beginning from February 2025, following their reinstatement by the Court of Appeal.

They are also asking the court to determine whether the Osun State Independent Electoral Commission (OSSIEC) could validly conduct new LG elections on February 22, 2025, while their tenure was allegedly still in effect.

The LG administration dispute in Osun has remained a contentious issue since the February 10, 2025 judgment of the Court of Appeal, which reinstated the previously elected APC Chairmen and Councillors, overturning their earlier removal.

At Monday’s proceeding, Muhydeen Adeoye, counsel to the claimants, introduced a motion seeking an interim injunction to restrain the defendants from interfering with his clients’ positions pending the determination of the substantive suit.

However, counsels for the 3rd and 4th defendants (Barr. F.K. Labo-Popoola), the 5th defendant ( Rachael Ojomi), and the 6th defendant ( J.A. Ayanyemi) all argued that they were still within time to respond to the originating summons and had not yet filed their defence.

Justice Adefunmilola Demi-Ajayi, presiding over the matter, noted that service had not been completed on all parties, and directed the claimants’ counsel to ensure proper service before the next adjourned date.

The judge, who earlier assured parties of an expeditious hearing, thereafter adjourned the matter to November 27, 2025, for substantive hearing.
