Court dissolves 10-year old marriage over infidelity

A Grade ‘A’ Customary Court sitting in Odigbo has dissolved a 10-year-old marriage between Mr Omotebi Iwaloye and his estranged wife, Mrs Nike Iwaloye, on the grounds of adultery.

Earlier, the petitioner, Mr Omotebi Iwaloye, approached the court seeking the dissolution of his marriage on the grounds of adultery, cruelty, and ill-treatment.

The 67-year-old petitioner, who is a farmer, told the court that he was no longer interested in the marriage, alleging that his wife had become violent and often engaged in physical fights with him, calling him unprintable names.

He further stated that the respondent, upon learning that she was required to appear in court, failed to attend any of the proceedings.

The court, presided over by Mr Adenigbo, ordered the dissolution of the union based on the petitioner’s evidence.

According to the judgment, there was no longer love between the petitioner and the respondent, as the latter had been cruel to her husband.

The court held: “There is no love in the marriage, desertion and adultery are evident from the petitioner’s testimony. In the circumstances, the marriage has failed and broken down irretrievably.”
