Court dissolves 25-year-old marriage

An Okitipupa Magistrate Court has dissolved a 25 -year -old marriage between Mr Tomisin Kayode and his wife, Mrs Kikelomo Kayode on the grounds of cruelty and ill treatment.
In his judgment, Mr. O.Adedeji said that the court found out that the relationship between the two arties was lacking in love and understanding. The court held that since all efforts to reconcile both parties by court has failed, not granting the petitioner’s prayers may lead to further exceptional hardship and depravity.The petitioner, Kikelomo Kayode, had earlier approached the court in August 2018, for the dissolution of her marriage with the estranged husband, Tomisin Kayode, on the ground of irreconcilable differences, which she said has not given her peace of mind since the beginning of
their relationship. Consequently, she instituted an action at the court against her husband whom she claims she does not love again. The respondent, Tomisin Kayode did not file a counter affidavits,
even though he was given the opportunity. The court, however, asked both parties to maintain status-quo on the custody of the only child of the marriage; Aina Kayode who is an adult. “I hold that the custody of Aina will not be granted to anybody because she is an adult who is not mentally or physically ill from the evidence given by the parties. “It therefore means that she can take decision by herself,” Adebisi ruled.
