Court dissolves 8 year-old marriage

An Okitipupa customary court has dissolved eight year-old marriage between Mrs. Famoye Ajeyemi and Mr. Sunday Famoye.

The court dissolved the marriage following a petition filed by Mrs. Famoye Ajeyemi urging it to dissolve her marriage with her husband Mr. Sunday Famoye on the grounds of ill treatment , cruelty and neglect.

The petitioner , Mrs. Famoye Ajeyemi was able to discharge the burden of proving that she had long suffered and endured for eight years and that she could no longer continue.

She added that her estranged husband has married two other wives that mothered children for him while he abandoned her, abused her and beat her because she was unable to have a child for him after  six miscarriages.

Mr. Sunday Famoye was unable to rebut the allegation, he only said he still love his wife and he was not ready for a divorce.

In his judgement, Mr. Adedeji O. Adebisi said since all efforts to reconcile both parties by the court has failed and not granting the petitioner’s prayer may lead to further exceptional hardship and depravity.

“The marriage has failed and broken down irretrievably as the petitioner has discharged the burden of proving that she has long suffered and endured for several years,  ” he said
