Court dissolves marriage over constant beating of wife

An Okitipupa Grade ”A” Magistrate Customary Court has dissolved the eight-year-old marriage between Mrs. Olayinka Akinmoladun and Mr. Kolawole Akinmoladun on the grounds of ill treatment, cruelty, abdication of responsibilities and constant beating .
The petitioner, Mrs. Olayinka Akinmoladun was able to discharge the burden of proving that she had long suffered and endured for eight years and therefore could not continue any longer
She hinted the court that her estranged husband always fight and beat her on trivial issues thereby turning her to a punching bag.
In her words: “he always beats me even without provocation and later pester me to have sex with him even though he is not ready to be responsible for the upbringing of the existing children”
The claims which the respondent, Mr. Kolawole Akinmoladun could not controvert since he absconded himself throughout the trial even when all the necessary notices were served on him.
The marriage is blessed with four issues – who are all minors .
In his judgement, the presiding Magistrate, Adedeji O. Adebisi said: “the final opportunity to hear the respondent’s side of the story would have been today, but the respondent has failed to come and tell his side of the story, this is without doubt, a strategy to frustrate this matter and to further keep the court waiting endlessly
Adedeji added that since the children of the marriage are all minors. ” I am therefore of the opinion that the dissolution is necessary since it will be detrimental for them to see marriage from the angle their father is handling it” he said
On the whole ,the presiding judge ruled that the marriage is hereby dissolved and the petitioner shall refund the sum of N2500 as dowry to the respondent through the court .
