Court remands bricklayer for defilement

A 29-year-old bricklayer, Abiodun Babatunde, has been remanded by the Chief Magistrates’ Court in Ondo town, for having unlawful carnal knowledge of one Posi Oladimeji.

The police brought Abiodun before the court on Tuesday for defiling the victim on May 8, 2019, at No 45, Olorunkole street, Yaba, Ondo.

The defendant is facing one – count charge bothering on carnal knowledge, which the prosecution said was contrary to and punishable under section 218 of the Criminal Code Cap 37 Volume 1 Laws of Ondo State of Nigeria, 2006.

The charge sheet read in part,”That you, Babatunde Abiodun, on May 8, 2019, at about 9am at No 45, Olorunkole street Yaba, Ondo, in the Ondo Magisterial District did unlawfully has carnal knowledge of one Posi Oladimeji  and thereby committed an offence contrary to and punishable under section 218 of the Criminal Code, Cap 37, Volume 1 Laws of Ondo State of Nigeria, 2006.

The plea of the defendant was not taken.

The police prosecutor, Gbenga Akinsulire, urged the court to remand the defendant in Shegede prison custody in Ondo, pending the issuance of legal advice from the Director of Public Prosecution (DPP) in the Ministry of Justice.

Lawyer for the defendant, Oladire Abayomi, did not oppose the application made by the prosecutor to remand his client.

The presiding Magistrate, Mrs Odenusi Fadeyi, who ordered the remand of the defendant in prison custody, said the case file should be transferred to the DPP’s office.

She further directed that hearing notice should be served on the DPP and the police, while the case was adjourned till June 17, 2019 for outcome of the legal advice.
