Court remands Okada rider  for alleged armed robbery

An Akure Chief Magistrates’ Court yesterday ordered the remand of a  27-year-old Okada rider, Joseph Emmanuel (A.K.A) Omoeye, in Olokuta prison custody  over alleged armed robbery.

The accused was brought on a three count-charge of felony to wit armed robbery and being in possession of firearms.

The police prosecutor, Sergeant Joseph Emmanuel said Emmanuel and others at large on September 17,  2018 at about 07:40pm, at Oda road, Akure, conspired with some hoodlums at large to commit felony to wit armed robbery.

Sulaiman added that on same day, time and at the aforementioned district, the accused and others at large, while armed with gun and other offensive weapons, robbed one Olatunji Karemu, of one TVS  unregistered motorcycle with engine number HF5AJ1321916, chassis number 5583 valued at N234, 000.

He informed the court that a locally made pistol and one expended cartridge was thereafter found in the possession of the accused, who could not give account of how he came about it.

He said the alleged offence contravenes section 6(a) and (b), 1(2) (a&b)  and 3(1)  of the Robbery and Firearms (special provision)  Act. Cap R 11. Laws of the Federation of Nigeria, 2004.

The plea of the accused was not taken.

Sulaiman presented to the court an application on notice to remand the accused person in Olokuta prison custody pending the issuance of the Legal Advice from the officr of the staye Director of Public Prosecution (DPP).

He informed the court that  both the original and the duplicate case files are already in court.

Lawyer to the defendant, Mr Bosun Otitoju, did not oppose the application made by the prosecutor, but prayed the court to order the prosecutor to make available to the court both the original and the duplicate of the case file for quick dispensation to the DPP’s office for a legal advice.

The Magistrate, Mrs Victoria Bob-Manuel, ordered the remand of Emmanuel in prison custody pending the legal advice from DPP.

She mandated the court clerk to dispatch the duplicate case file to the DPP’s office, while the original case file should be forwarded to the office of the  Chief Registrar for safe keeping.

She  adjourned the case till February 25,  2019 for review and outcome of the DPP’s advice.
