Divorce: My husband poisoned my food, wife tells court

A Grade ‘A  Customary Court in Ibadan, Oyo State, on Friday, dissolved a 21-year old marriage following allegations of poisoning and domestic violence levelled against one Olatunde Kumunyi, by his wife, Omotayo Kumunyi, an Ibadan-based caterer.

Omotayo, who resides in the Osungbade area of Ibadan, revealed that her husband failed to provide for her and their four children. She explained that when the situation became unbearable, she moved out with three of the children, leaving the second child behind.

“My lord, about five years ago, our third child confided in me that she usually saw her father pouring some black substance into my own food, whenever I was not there.

 “I was shocked by this piece of information and confronted him with the revelation. Subsequently, I invited him to eat part of the food and he declined tasting from it,”Omotayo testified.

He also accused her husband of regularly abusing her and their first child.

 “As if that was not enough, Olatunde regularly turned our first child and I, to a punching bag anywhere he came across us,” she added.

Concerned for the children’s well-being, she requested custody, stating that Olatunde would not properly care for them. While Olatunde largely refrained from responding to the majority of the allegations, he acknowledged paying dowry to Omotayo’s  parents.

Olatunde, a carpenter who lives at No. 2, Olatunde Street, Police Post at Challenge in Ibadan, presented a proposal for the children’s upkeep. He stated that he would be willing to pay N5,000 monthly for their care, should the court deny him custody.

“I want to take custody of the children because Omotayo has the habit of maltreating the last two children. The second child with me has been going to school regularly,” Olatunde argued.

In her judgment, President of the court, Mrs S.M. Akintayo, dissolved the marriage, confirming that it was valid based on the evidence presented by both parties.

She granted Omotayo custody of the last three children and ordered Olatunde to pay N20,000 monthly for their feeding, as well as cover their education and other welfare needs.

“The first child is 18 years of age and because he is an adult by law, he has the right to choose whoever to live with between his two parents. However, the petitioner must allow the respondent a reasonable access to the children,” Akintayo stated.

Furthermore, the court issued a restraining order, preventing Olatunde from threatening, harassing, disturbing, or interfering with Omotayo’s private life, going forward.
