Fashion designer docked for assaulting boy, 12

A 20-year-old fashion designer, Omotuyolemi Elijah has been dragged before the Chief Magistrates’ Court in Ondo, for unlawfully assaulting a 12-year-old boy, John Alex by using a wood to flog him and inflicted injury all over his body.
The police brought Elijah before the court for conspiring with one other to commit the offence.
The defendant with his partner was said to have indecently dealt with one John Alex by using a rope to tie him down under hot sun.
The defendant who is now facing three – count charge bothering on conspiracy and was said to have committed the offence May 28 ,2019 at about 12am at No 27 Jilalu street, New town Ondo.
The charge sheet read in part: “That you Omotuyolemi Elijah and one other at large on the same date, time and place, in the aforementioned magisterial district did unlawfully assault one John Alex, age 12, by using a wood to flog him and inflicted injury all over his body and thereby committed an offence contrary to and punishable under section 356 of the Criminal Code Cap 37 Volume 1 Laws of Ondo State of Nigeria 2006.
“That you Omotuyolemi Elijah and one other at large on the same date, time and place, in the aforementioned magisterial district did unlawfully assault one John Alex age 12, by using a rope to tied him down and put him under hot sun and thereby committed an offence contrary to and punishable under section 216 of the Criminal Code Cap 37 Volume 1 Laws of Ondo State of Nigeria, 2006.
The police prosecutor, Adebiyi Abiodun applied for a date to enable him study the case file.
The defence counsel, Tomiwa Akinnugba applied for the bail of his client in most liberal terms.
The presiding magistrate, Mr Damilola Sekoni, granted the defendant bail in the sum of N100,000 with two sureties in like sum.
He said the sureties must be residents within the jurisdiction, they must attached affidavit of means, passport of the defendant and sureties must be attached also.
Sekoni directed that the case file should be duplicated and sent to the office of the DPP in the Ministry of Justice and adjourned the case till September 6, 2019 for trial.
