Guard, 33, remanded over alleged murder-

An Akure Chief Magistrate Court sitting at Oke-Eda, has remanded a 33-year-old guard, Jimoh Abdullahi,  in Olokuta prison custody  for allegedly killing one Oreoluwa Kayode, with a single barrel gun.

According to the prosecution, the offence was committed on  February 22, 2019, at about 5:30pm at Ita-Olughogho via Ondo, in the Ondo Magisterial District, while on duty as a day guard. Abdullahi was said to have  killed one Oreoluwa Kayode, by shooting him on the head when the deceased and two others were struggling  with him over a single barrel gun.

The accused person was charged on  one count-charge of murder.

The offence was said to contravene section 316 and punishable under section 319{1}of the Criminal Code, cap37, Volume 1, Laws of Ondo State of Nigeria, 2006.

No plea was  taken from the accused person when the charge was read to him.

The prosecutor,  Sergeant Suleiman Abdullateef, told the court that the complainant and the deceased family had brought  a petition  to withdraw the case.

The court discountenanced the application for withdrawal, saying “law is law, and since the case has already been  brought before the court, it has to follow  due process”.

Abdullateef therefore, asked for the remand of the accused person in Olokuta prison pending the  legal advice from the Director of Public Prosecution, DPP.

Lawyer for the accused person did not object to the remand application.

The Magistrate, Mrs Victoria Bob-manuel, ordered the remand of the defendant in Olokuta prison custody pending the issuance of the legal advice from the DPP’s office.

She ordered the prosecutor to submit both the original and the duplicate case file to the court clerk for quick dispensation.

The magistrate, however, noted that, , the complainant and the deceased family could  approach the High Court for withdrawal.

She adjourned the case  till April 11, 2019, for review.

  The Hope Metro had exclusively reported  last week, that the dead body of the deceased, Oreoluwa Kayode was found in a sewage.

Prior to the arraignment, the State Police Public Relations Officer, Mr. Femi Joseph, told The Hope Metro that the suspect, Abdullahi, was arrested in connection with Kayode’s death

Joseph said, ” The suspect is a security man guarding the land,  while the deceased was  a known thug in the area. During interrogation , the suspect told us that the deceased and two others went to the land to extort money and engaged in a fight with him because he prevented them from operating .

” He told us that the deceased and  two others were struggling to collect his locally made gun from him. He said it was during the struggle that one of the thugs pull the trigger of the gun and killed the deceased , he said.”

The PPRO added that the other two members of the gang that accompanied  the deceased to the scene are on the run.
