Herbalist, one other charged with theft

A 43-year-old herbalist, Ojo Akingbadega and a 31-year-old man, Bankole Ibukun, have been dragged before the Chief Magistrates’ Court in Ondo town, for stealing the sum of N26,000, belonging to  one Kemisola Akinyele.

The defendants are  facing  two counts bothering on stealing and conspiracy.

The prosecution said the duo committed the offence on September 4, 2019, contrary to and punishable under sections 516 and 390(9) of the Criminal Code, Cap 37, Volume 1, Laws of Ondo State of Nigeria, 2006.

The charge sheet read in part,”That you, Bankole Ibukun and Ojo Akingbadega, on September 4, 2019 at No 2,  Otuyemi street via Akure motor park, Ondo, in the Ondo Magisterial District, did conspire to commit felony to wit stealing and thereby committed an offence contrary to and punishable under section 516 of the Criminal Code, Cap 37, Volume 1, Laws of Ondo State of Nigeria, 2006.

“That you, Bankole Ibunkun and Ojo Akingbadega, on the same date, time and place in the aforementioned Magisterial District, did steal the  sum of N26,000, property of one Kemisola Akinyele, and thereby committed an offence contrary to and punishable under section 390(9) of the Criminal code Cap 37, Volume 1 laws of Ondo State of Nigeria 2006.

The defendants pleaded not guilty to the charges.

The police prosecutor, Mr Adebiyi Abiodun,  told the court that he would be calling three witnesses to testify in the case. He applied for a date to enable him study the case file.

Lawyer for the accused, Barrister Orlu Orlu Mills, therefore, prayed for the bail of the defendants in most liberal terms.

The presiding Magistrate, Mr Damilola Sekoni, granted the defendants bail in the sum of N20,000 with one surety in like sum.

He said the surety must be resident within the jurisdiction, which must be confirmed by the court’s orderly and reported back to court.

He adjourned the case till September 26, 2019 for trial.
