A Chief Magistrates’ Court in Ondo town, has ordered the remand of a 31-year-old man, Rotimi Olaniyi, in Olokuta prison, for unlawful and indecent assault of a girl (names withheld), by touching her private part without her consent.
The police said Olaniyi allegedly touched the girl’s private part without her consent on November 13, 2018.
He was arraigned before the court on Friday, on two count charge bothering on attempt to commit an offence to wit felony and assault.
He was said to have committed the offence on the November 13, 2018, contrary to Section 508 and punishable under Sections 509 and 360 of the Criminal Code Cap 37, Volume 1, Laws of Ondo State of Nigeria, 2006.
The charge sheet read in par:, “That you, Olaniyi Rotimi on November 13, 2018 at about 2.45pm at Akinkugbe street, Ondo, did attempt to commit an offence to wit felony and thereby committed an offence contrary to Section 508 and punishable under Section 509 of the Criminal Code, Cap 37, Volume 1 Laws of Ondo State of Nigeria, 2006.
“That you Rotimi Olaniyi on the same date, time and place in the aforementioned magisterial district did unlawfully and indecently assaulted the girl by touching the private part of her body without her consent and thereby committed an offence contrary to and punishable under section 360 of the criminal code cap 37 volume 1 laws of Ondo State of Nigeria 2006.
Olaniyi pleaded not guilty to the charges.
The police prosecutor, Charles Olagbayi, who told the court that he would be calling four witnesses to testify in the case, applied for a date to enable him study the case file.
Lawyer for the accused, Mr O. O. Onipe, applied for the bail of his client in most liberal terms.
But the presiding Magistrate, Mrs Odenusi Fadeyi, refused to grant the accused bail.
She, ordered his remand in prison custody.
She adjourned the case till 26, November, 2018 for consideration of bail and trial.
