An Akure Chief Magistrates’ Court on Tuesday remanded a 35-year-old man, Segun Aminu, in Olokuta prison for matcheting a man on his head over land dispute.
The police brought the accused before the court on a three-count charge of conspiracy, assault and attempted murder.
According to the prosecution, Aminu attempted to kill one Dada Aladejana, at about 2:30pm on December 12, 2018 at Oke-Igbede, along Ikare/Akungba Akoko road, Ikare Akoko, in the Ondo State magisterial district.
The accused was said to have used cutlass and wood to inflict injury on the head of the complainant. during a land dispute.
The prosecution said the offences contravened Section 516(A), 320(1&2) and 355 of the Criminal Cde Cap 37, Volume 1, Laws of Ondo State of Nigeria, 2006.
The plea of the accused was not taken.
The Police prosecutor, Sergeant Suleiman Abdulateef, urged the court to remand the accused person at Olokuta prison, since the court has no jurisdiction over the count two of the case and also to enable the court to send the duplicate case file to director of public prosecution for a legal advise.
He prayed the court for an adjournment pending the outcome from the DPP’s office.
Counsel to the accused person, Mr Femi Adetoye, objected to the application for remand made by the prosecutor, submitting that it is a bailable offence.
He, therefore, urged the court to discountenance the remand application made by the prosecutor and grant the accused bail.
In her ruling, the Magistrate, Mrs Victoria Bob-Manuel, ordered the remand of the accused person in Olokuta prison custody, pending the issuance of the legal advice from the Director Of Public Prosecution.
She directed the prosecutor to hand over both the original and the duplicate case file to the court clerk.
She, therefore, adjourned the case till January 23,2019.
