 Man docked over burglary, theft

A 35-year-old furniture maker, Raphael Adeniyi has been remanded by the Chief Magistrate  Court in Ondo town, for unlawfully breaking into the dwelling house of one Ibrahim Abubakar, where he allegedly stole phones and  N110,000.

The police brought Adeniyi before the court for conspiring with others at large to commit felony to wit stealing.

IThe items stolen were; one infinix Hot 7 mobile phone, valued at N42,000:00, one item mobile phone valued at N5,000, one Tecno mobile phone valued at N8,000:00 and the sum of N55,000.

The defendant is now facing three – count charge bothering on conspiracy, burglary and stealing.

The defendant was said to have committed the offence in October 6, 2019, between 10:00pm to 6am at Sabo market, Ondo, contrary to section 383 and punishable under sections 516, 412 and 390(9) of the Criminal Code Cap 37, Volume 1 Laws of Ondo State of Nigeria, 2006.

The charge sheet read in part, “That you, Raphael and others at large on the same date, time and place, in the aforementioned Magisterial District did steal one infinix Hot 7 mobile phone, valued at N42,000:00, one item mobile phone valued at N5,000:00, one  Tecno mobile phone valued N8,000:00 and cash of N55,000:00 total valued N110,000:00 property of one Ibrahim Abubakar and thereby committed an offence contrary to section 383 and punishable under section 390(9) of the Criminal code cap 37  Vol. 1 laws of Ondo State of Nigeria 2006.

The police prosecutor, Gbenga Akinsulure, prayed the court to remand the accused in prison custody pending advice from the Director of Public Prosecution.

The plea of the defendant was not taken and he was not legally represented.

The presiding Magistrate, Mrs Odenusi Fadeyi, granted the application of the prosecutor and ordered that the case file should be sent to the office of the Director of Public Prosecution.

 Consequently, the magistrate ordered the remand of the defendant at Segede Correctional Centre and adjourned the case till May 12, 2020 for legal advice from the DPP in Ministry of Justice
