Middle-aged man in court over breach of peace

A 28-year-old Commercial motorcyclist, Friday Phillips, has been dragged before the Chief Magistrates’ Court in Ondo town, for behaving in a disorderly manner in order to cause breach of the peace in public place.
Philips, who is now facing a one- count charge bothering on conduct likely to cause the breach of the peace, however, pleaded not guilty to the charge preferred against him.
The defendant was said to have committed the offence on March 8, 2019 at about 5pm at Idi-Ishin area, in Ondo, contrary to and punishable under section 249(a)(i) of the Criminal Code Cap 37 Volume 1 Laws of Ondo State of Nigeria 2006.
The charge sheet read in part,”That you, Friday Philips on March 8, 2019, at about 5pm at idi-ishin area, Ondo, in the Ondo Magisterial District did in a public place conducted yourself in a manner to cause the breach of the peace by behaving in a disorderly manner and thereby committed an offence contrary to and punishable under section 249(a)(i) of the Criminal code cap 37 volume 1 laws of Ondo State of Nigeria 2006.
The police prosecutor, Joseph Ajayi, who told the court that he would be calling two witnesses to testify in the case, applied for a date to enable him study the case file.
Lawyer for the defendant, Mr. P .O Afolayan applied for bail for the defendant in most liberal terms.
The presiding Magistrate, Mr Damilola Sekoni granted the defendant bail in the sum of N50,000 with one surety in like sum.
He said the surety must be residents within the jurisdiction and adjourned the case till March 21, 2019 for trial.
