A middle-age woman, Mrs Enitetu Gbenro, has approached an Okitipupa Court seeking the dissolution of her 11-years-old marriage, over what she described as total neglect, cruelty and ill-treatment by her husband due to her in ability to have child .
Enitetu, a staff of the Okitipupa Local Government, narrated to the court how she had series of miscarriages as a result of her husband’s undue pressure and beatings.
According to her, there was a time she under went a caesarian operation to deliver a baby, but unfortunately she had a still birth .
Aggreived and not satisfied with the situation, she pleaded with the court for a separation with her estranged husband, Mr. Kayode Enitetu, so as to live her life in peace and quietness.
During cross examination, the respondent, Kayode Enitetu, did not controvert the allegations against him. But he pleaded with the court that he would amend his ways, blaming the devil for some of his conducts.
In his judgement, the presiding magistrate, Mr. Adedeji. O. Adebisi said, ” it is worthy of note that the court cannot compel an unwilling and suffering party in a marriage to continue to suffer in the marriage. More so, when the party responsible for the suffering has not successfully been able to rebut the claim that the petitioner is suffering under him “
Adedeji pointed out that not granting the prayers of the petitioner may lead to further exceptional hardship and depravity .
He concluded that the marriage had failed and broken down irretrievably, as the petitioner has discharged the burden of proving that she had long suffered and endured for several years.
Adedeji dissolved the marriage and ordered the petitioner to refund the sum of N2,500 paid for her dowry back to petitioner through the court .
