‘My wife is an adulterer’

A Maroko Customary Court in Ondo, Ondo West Local Government of Ondo State on Friday dissolved the 10-year-old marriage between Mr. Adisa Ibrahim and Titilayo Fiola, over desertion, hostility, adultery and lack of love .

Ibrahim had on May 2, 2018, approached the court seeking the cancellation of the association, accusing his wife of adultery, desertion, hostility and lack of love also said the wife was irresponsible.

The petitioner, Mr Adisa Ibrahim,  had on April 26, 2018, filed the suit at the court  asking the court to  dissolved the  marriage between him and his enstranged wife on the grounds of cruelty, maltreatment, irresponsibility, hostility, non-challant attitude, desertion, adultery and lack of love.

However, the respondent in her defence,  insisted that the petitioner only paid her house rent during the first year of their relationship. He  claimed that  he had  been living on her income.

She prayed the court to cancel their association, based on hostility, desertion and lack of love.

She also sought for  the order of the court awarding the custody of the two children to her because she had been taking care of them since their birth.

The President of the court, Chief Ayoola Loghofale, while giving the verdict, said, “there is no marriage between the parties and in as much as the petitioner did not pay any dowry on the respondent, it was just a mere association.

“Once the two parties have consented to the cancellation of their marriage, then there is evidence that the relationship has broken down irretrievably.

“Therefore, the association between the two is hereby cancelled. Parties are free to go their separate ways and any party who may feel dissatisfied with this judgment can appeal within the next 30 days.

“Considering the welfare of the two children in the association, their custody is hereby granted to the respondent.

The court  ordered the petitioner to pay the sum of five thousand naira (5,000), on each of the two children, as maintainance and welfare allowances,  beginning from October 2018.

Ibrahim was also ordered to  be responsible for the school fees of the three children.
