Any person who
(a) vitiates the atmosphere in any place so as to make it noxious to the health of persons in general dwelling or carrying on business in the neighborhood or passing along a public way; or
(b) does any act which is, and which he knows or has reason to believe to be, likely to spread the infection of any diseases dangerous to life, whether human or animal;
is guilty of a misdemeanor, and is liable to imprisonment for six months.
Section 247 of the Criminal Code Act
Noxious Act is one of the offences against Public Health. It is the legal duty of everyone to keep the environment safe and habitable for others.
Wrongful waste disposal is a notorious example.
Dumping of refuse, human or animal excrement inside or around rivers and stream is capable of spreading water borne diseases.
Proper waste management is encouraged for the well being of all.
Air pollution through the use of toxic substances for fumigation and weed control is another example.

Wrongful disposal of industrial waste causing Oil spill is another example.
Burning of noxious substance for spiritual rites is common in some neighborhood.
The economic, spiritual or personal activities of a person should not erode other people their basic rights to a healthy and habitable environment.
