Septuagenarian jailed for stealing brother’s machines

A 70-year-old farmer, Ayodeji Fasanya, has been sentenced to 12 months imprisonment by an Ondo Magistrates’ Court for stealing eight industrial sewing machines valued at N880,000, property of his brother, Otunba Olanrewaju Fasanya.
The trial magistrate, Mrs Odenusi Fadeyi, while sentencing the Septuagenarian, held that the prosecution had proved the allegations against him beyond reasonable.
He was given an option of N50,000 fine.
According to the prosecution, the convict committed the offence on June 5, 2019 at about 2.00 a.m. at No 3, Agboore street, Ondo town.
The charge read in part, “That you, Ayodeji Fasanya on June 5, 2019 at about 2:00am at No 3 Agboore street, Ondo in the Ondo Magisterial District did break and enter into the dwelling house of one Otunba Olanrewaju Fasanya, with intent to commit felony therein and thereby committed an offence contrary to and punishable under section 411 of the Criminal Code Cap 37 Volume 1 Laws of Ondo State of Nigeria, 2006.
“That you Ayodeji Fasanya, on the same date, time and in the aforementioned Magisterial District did steal eight industrial sewing machines valued at N880,000, property of one Otunba Olanrewaju Fasanya and thereby committed an offence contrary to and punishable under section 309(9) of the Criminal Code Cap 37 Volume 1 Laws of Ondo State Nigeria, 2006.
The convict pleaded guilty to the charge.
The prosecutor, Sgt. Gbenga Akinsulure, informed the court that the convict and the complainant are brothers.
Following the guilty plea, the defence counsel, Mr Soji Okewoye, prayed the court to temper justice with mercy in sentencing his client.
The Chief Magistrate, Mrs Odenusi Fadeyi, who said she had considered the allocutus of the defence counsel and also the circumstances surrounding the case, sentenced the convict to 12 months imprisonment.
She directed the prosecutor to be in custody of the remaining items for the 12 calender months.
