A 41-year-old trader, Mark Oke has been sentenced to two months community service for raping a 21-year-old lady.
Magistrate Mayomi Olanipekun in his judgement sentenced Oke to two months community service at the court premises after the case was withdrawn through an affidavit filed by the victim (names withheld).
Oke was ordered to clear the bushes at the court premises every Friday for the next two months.
The trader committed the offence on July 30, 2022 at about 1:30am. at Ijomu Area in Akure.
Earlier, the Prosecutor, Inspector Adeoye Adesegun, informed the court that the defendant unlawfully had canal knowledge of a 21-year-old girl (name withheld).
According to the prosecutor, the offence committed is contrary to Section 357 and punishable under Section 358,360 of Criminal Code Cap 37. Volume 1. Laws of Ondo State Nigeria, 2006.
The defendant pleaded not guilty to the charge leveled against him.
The Defence Counsel, C.T Fagbohun told the court that the family of the defendant had met with the victim’s family.
He said after much pleas and intervention, the complaint agreed to drop the charge against the defendant.
He said the victim filed an affidavit of withdrawal and the copy of which is placed in the file.
He, therefore prayed the court to grant their wish to withdraw the case.
Fagbohun pleaded that the defendant should be reporting to the court so that the court will know that he has really changed.
