Two men, Oyekanmi Ojo, 23, and Olawale Ogundaisi, 31, have been dragged before an Akure Chief Magistrates’ Court sitting at Oke-Eda, Akure over alleged murder of one Festus Asangwor.
The police brought the defendants before the Magistrates’ Court presided over by Mrs Victoria Bob-Manuel, on two counts of conspiracy and murder.
The prosecution said the defendants committed the offence on the 23rd day of Octomber 2018 at about 11:50pm at Lala junction, Ipele via Owo in Ondo State magisterial district.
The defendants were alleged to have stabbed 38-year-old Festus Asangwor, with knife, which resulted to his death.
The offence was said to be contrary to section 316 and punishable under section 324 and 319(1) of the Criminal Code Cap 37 Volume 1 laws of Ondo State 2006.
The plea of the defendants were not taken when the charge was read.
The police prosecutor, Sergeant Sulaiman Abdulateef, urged the court to remand the accused person in Olokuta prison custody to enable him send the duplicate of the case file to the Director of Public Prosecution(DPP), for legal advice, since the magistrate court lacks jurisdiction over the matter.
He prayed the court for an adjournment pending the outcome of the legal advice..
Counsel to the defendants, Thankgod Helper and A.y Aliyu, did not oppose the remand application made by the prosecutor.
The Magistrate, ordered the remand of the two defendants, Ojo and Ogundaisi, in Olokuta prison custody pending the issuance of the legal advice by the Director of Public Prosecution..
She directed that both the original and the duplicate of the case file be handed over to the court clerk by the prosecutor.
The court also mandated the court clerk to dispatch the original case file to the office of the Chief Registrar, Ondo State judiciary, for safe keeping. While he should send the duplicate to the office of the Director of Public Prosecution for legal advice without delay.
The case was adjourned till December 5, 2018 for a review.
