Labourer remanded for defiling 2-yr-old

A 22-year-old labourer, Bassey Oraviet has been remanded by the Chief Magistrate Court in Ondo town, for unlawfully and indecently assaulting a 2-year-old girl (names withheld) by releasing sperm into her private part.
The police brought Oraviet before the court on three-count charge of rape.
The police prosecutor, Mr Gbenga Akinsulure said he committed the offence on September 1, 2019 at about 08.45am at Kabiasi Camp via Ondo.
The charge read in part,”That you, Bassey Oraviet on September 1, 2019, at about 08.45am at Kabiasi Camp via Ondo, in the Ondo Magisterial District did unlawfully and indecently assault the victim, aged 2, by releasing sperm into her private part and thereby committed an offence contrary to and punishable under section 360 of the Criminal Code Cap 38 Volume 1 laws of Ondo State of Nigeria, 2006.
“That you Bassey Oraviet on the same date, time and in the aforementioned magisterial district did commit felony to wit defilement and thereby committed an offence contrary to and punishable under section 509 of the Criminal code cap 37 volume 1 laws of Ondo State of Nigeria 2006.
“That you Bassey Oraviet on the same date, time and in the aforementioned magisterial district did conduct yourself in a manner likely to cause the breach of peace by attempt to have carnal knowledge of the victim and thereby committed an offence contrary to and punishable under section 249(d) of the Criminal code cap 37 volume 1 laws of Ondo State of Nigeria 2006.
The defendant pleaded not guilty to the charges.
Akinsulure, prayed the court to permit him substitute the charges in the next adjourned date while calling three witnesses to testify in the case.
The defence counsel, Israel Ikuemonisan did not oppose the application made by the prosecutor to substitute the charges, he therefore apply for the bail of the defendant in most liberal terms.
The presiding magistrate, Mrs Odenusi Fadeyi ordered that the defendant be remanded in prison and adjourned the case till October 4, 2019 for bail consideration.
